Welcome to Jeeveslive - The Terms of Use herein create a legally binding agreement (“Agreement”) between you and Jeeveslive (“Jeeveslive”) governing your access to and use of the Jeeveslive website (“Site”) and all other associated services (collectively, “Jeeveslive Services.”) The Site and Jeeveslive Services together are hereinafter collectively referred to as the “Jeeveslive Platform.”
These Terms of Use provide basic regulatory information about the Jeeveslive Platform, and govern your use of the Jeeveslive Platform. When you create a Jeeveslive account or use the Jeeveslive Platform, you agree to these Terms of Use.
The Jeeveslive Platform
Jeeveslive Platform is an online social marketplace enabling a registered user (“Seller”) to
(a) advertise service gigs/ads on the Jeeveslive Platform (“Listing”); and
(b) to connect, communicate and transact with any registered user (“Buyer”) who is looking to purchase, or offer to purchase, such service gigs or item listed in ads.
The Terms of Use apply to your use of the Jeeveslive Platform in your capacity as a Seller, Buyer or both a Seller and Buyer.
You acknowledge that the Sellers are responsible for their Listings and that Jeeveslive doesn't own, create, sell, resell, control, offer, or deliver Listings.
Accessing the Jeeveslive Platform
By using the Jeeveslive Platform, you acknowledge that you are at least 13 years old. Jeeveslive cares about your safety while you are online on our Platform. We understand that in this modern age, kids are on the internet more than ever, and free access to online gigs and classifieds can be a fun way for them to find toys, video games, clothing, and other age appropriate items. While we pride ourselves on being a Platform that the whole family can use, we also know the risks involved in internet transactions. In order to minimize such risks, we ask that anyone under 16 years of age have a parent or guardian respond to any Listing you may be interested in. Also, if you wish to post a Listing on Jeeveslive, please have your parent/guardian do so on your behalf. Jeeveslive reserves the right to remove any Listing if we feel it is in the best interest and for the safety of our users.
Access to the Jeeveslive Platform is permitted on only a temporary basis. Jeeveslive retains the right to withdraw, modify or suspend the Jeeveslive Platform without any notice. From time to time, Jeeveslive updates its Platform, and may modify the content at any time without any notice to you. Jeeveslive will not be liable in any manner if for any reason our Platform or any area of it is unavailable at any time.
You’re responsible for making every necessary arrangement required to access and view and use the Jeeveslive Platform. You’re responsible for ensuring that anyone accessing the Jeeveslive Platform using your internet connection is aware of the Terms of Use here.
Your Relationship with Jeeveslive
Jeeveslive is not and does not become a party to or other participants in any contractual relationship between any Buyer and Seller, nor is Jeeveslive a broker nor insurer.
No joint venture, employment, partnership or agency relationship exists between you and Jeeveslive under this Agreement or your use of the Jeeveslive Platform.
Your Account with Jeeveslive
To access and use features of the Jeeveslive Platform, such as posting a gig/ad, you must register for an account (“Jeeveslive Account”).
Your Jeeveslive Account will permit you to login to the Site and manage your Jeeveslive Account and make use of the Jeeveslive Platform. You agree to maintain correct, complete, and current information in your Jeeveslive Account. Your failure to maintain correct, complete and correct information for your Jeeveslive Account, including having an invalid or expired payment means, may result in your inability to access or use the Jeeveslive Platform.
You should not assign or otherwise transfer your Jeeveslive Account to any person or entity. You're responsible for every activity that occurs under your Jeeveslive Account and you agree to maintain the security of your Jeeveslive Account username password at all times.
Jeeveslive Payments
You may be required to pay a subscription fee should you wish to access Premium services. For the sake of facilitating such transactions, payment processing services through or in line with your use of the Jeeveslive Platform may be provided to you by one or more independent third-party entities, as appropriate (“Jeeveslive Payments”).
If you choose to use Jeeveslive Payments (PayPal), you hereby consent and authorize Jeeveslive to share any information you provide with any third-party service providers.
For such payments, you must have a valid payment method with us to pay all incurred and recurring charges. Jeeveslive will charge the payment method account that you authorize (“Authorized Card”) and will keep charging the Authorized Card (or any replacement card) until:
(a) your Authorized Card is rejected, and you don't provide a replacement, within 14 days; or
(b) you cancel your subscription for such features at least 24 hours before your scheduled payment date.
To update your Authorized Card, you may contact us. After any update, you authorize us to continue charging your Authorized Card.
You may choose to cancel your Jeeveslive Account by contacting us, and then following the instructions indicated to you in our response.
Terms Specific to Sellers
You must only list service gigs/ads which you own and/or which you are entitled to offer.
By creating a Listing, you represent to Jeeveslive and to other users that you're the owner of all Intellectual Property Rights and all other rights, title and interest in the service gigs posted by you.
Terms Specific to Buyers
As a Buyer, It is generally recommended that you conduct all inquiries/discussions about service gigs/ads using the chat module built into the Jeeveslive Platform. You can submit an offer to purchase service gigs/ads contained in a listed gig/ad on the Jeeveslive Platform. Although Jeeveslive recommends you use the chat module (for greater transparency), you are not required to use - and as such retain full responsibility for communications done outside of the platform.
As a Buyer, you accept sole responsibility for examining and investigating the services and all information contained in a posted gig. This includes, and not limited to, associated liabilities, and any other facts or information which may impact your decision to purchase the services and the price you are willing to pay. You understand that Jeeveslive may display only a summary description of the services.
For any payment for services contained in a Listing, you accept all risks and responsibilities for such a payment, and hold Jeeveslive harmless from any liability should a payment issue occur.
User Content
When you create a service gig as a Seller, you'll be asked to provide complete and correct information about your products or services including, but not limited to a description (“User Content”). You're responsible for keeping your Listing information current at all times.
When you share User Content to the Jeeveslive Platform, you grant us a license to use it. This means when you share, post, or upload content, you grant Jeeveslive a non-exclusive, irrevocable, perpetual, royalty-free, transferable, sub-licensable, worldwide license to host, use, distribute, modify, run, copy, publicly perform or display, translate, and create derivative works of your content, as well as the right to exercise all Intellectual Property Rights, including copyright and trademark rights you have in such content, now or in the future for any other purpose.
You also grant Jeeveslive the right to share User Content through a digital outlet, website, blog, or social media. This means that User Content can be shared via “Online Distribution”, which is the distribution of User Content directly to consumers for online viewing, either on a streaming or download basis, on a website (e.g., YouTube.com, Vimeo.com, personal or company website), or social media platform (e.g., Facebook, Instagram, Twitter, Snapchat, or TicTok), etc.
To the maximum level permitted by law (either present or future), you irrevocably and unconditionally consent to Jeeveslive and its assignees adapting, publishing, reproducing, exhibiting, transmitting, Jeeveslive, or otherwise using the User Content or an adaption of such User Content, anywhere in the world in any form and in any circumstance Jeeveslive thinks fit, including adding to or altering the content.
Prohibited Activities
You're solely responsible for compliance with all laws, rules, regulations and tax obligations that may apply to your use of the Jeeveslive Platform.
In connection with your use of the Jeeveslive Platform, you'll not assist or enable others to:
(a) breach any relevant laws or regulations, agreements with third-parties, Intellectual Property Rights, third-party rights, the Terms of Use or Privacy Policy.
(b) resell or sublicense the use of the Site or your Jeeveslive Account to any other person;
(c) use your Jeeveslive Account in a fraudulent or illegal manner, or email or send any materials from your Jeeveslive Account which are offensive, unlawful, harassing, libellous, defamatory, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable;
(d) dilute, tarnish or otherwise harm the Jeeveslive brand in any way,
(e) use your Jeeveslive Account to send or deliver viruses, malware, spyware, or other harmful, destructive or disruptive files;
(f) use your Jeeveslive Account in a way that damages the Site or denies access to the Site to other users of the Jeeveslive Platform.
Termination
This Agreement may be terminated by Jeeveslive immediately at any time:
(a) if you're in default or breach of the Terms of Use; and
(b) Jeeveslive has reasonable grounds to believe that you're a repeat infringer of copyright or any trademarks;
After the termination of this Agreement, any Listings which you have placed on the Jeeveslive Platform will instantly terminate.
Third Party Links
The Jeeveslive Platform may contain links to third-party websites or resources that we don’t own or control. When you access such third-party services, you do so fully at your own risk. The third parties may demand that you accept their own terms of use and privacy policies. Jeeveslive is not a party to such agreements — they are solely between you and the third party.
Copyright Policy
You acknowledge that Jeeveslive is the owner of all Intellectual Property Rights which subsist in your Jeeveslive Account and the Jeeveslive Platform (but not your products or services). You acknowledge that you've no Intellectual Property Rights in your Jeeveslive Account or the Jeeveslive Platform.
You acknowledge and agree that Jeeveslive won't be liable for any breach by any Buyer or Seller of any Intellectual Property Rights or other rights controlled by a third party in relation to the supply or purchase of the services or in relation to a Listing.
All Content on the Services are owned by Jeeveslive or our third-party licensors (and are covered by international copyright, patent, design, trademark laws, and other laws protecting any intellectual property and related proprietary rights). All such rights are reserved to Jeeveslive and our licensors.
You acknowledge that Jeeveslive and any other brands or logos that belong to us within the Jeeveslive Platform are the Jeeveslive trademarks (the “Jeeveslive Trademarks”) and that you may not use them without getting a written consent from Jeeveslive.
You agree not to alter or remove any copyright, trademark, patent, or other proprietary rights notices showing on the Jeeveslive Platform.
Making unauthorized copies of Content available via or found on the Jeeveslive Platform may lead to the prohibition of your use of the Platform and relevant further legal action.
Jeeveslive has high regard for the intellectual property and other rights of others, and Jeeveslive requests its users to do the same. Jeeveslive may, in applicable circumstances and based on sole discretion, terminates the access of users who violate the rights of others.
If you notice or believe that your content or work has been copied and is accessible on the Jeeveslive Platform in a way that can be regarded as copyright infringement, or that the Jeeveslive Platform has links or other references to another website that has material or activity that violates your copyright, please contact us.
Disclaimer
The Jeeveslive Platform is provided “as is” and “as available.” Jeeveslive disclaims all representations and warranties, whether express, implied, or statutory, not clearly states in the Terms of Use, including the implied warranties of merchantability, fitness for any purpose and non-infringement. In addition, Jeeveslive makes no representation, warranty or guarantee about the reliability, timeliness, suitability, quality or availability of the Jeeveslive Platform or any services or goods bought or sold via the use of the Jeevesliive Platform, or that the Jeeveslive Platform will be uninterrupted and error-free.
Jeeveslive has no control over and doesn't guarantee:
(a) the existence, quality, or suitability of legality of any Listing;
(b) the correctness or completeness of any Listing description;
(c) the future performance of any services described in any Listing;
(d) the performance or behaviour of any Buyer or Seller or third party on, or beyond the Jeeveslive Platform.
You agree that the entire risk resulting from your use of the Jeeveslive Platform, and any products or services requested in connection therewith, remains solely with you, to the maximum level permitted under applicable law.
Limitation of Liability
Jeeveslive shall not be liable in any way for any indirect, incidental, exemplary, special, punitive or consequential damage, including lost profits, lost data, personal injury or property damage related to, in line with, or otherwise owing to any use of the Jeeveslive Platform, Listings or other products and services offered under this Agreement, regardless of any violation or default by, or any negligence (whether affirmative, active, sole or concurrent) of Jeeveslive.
The maximum aggregate liability of Jeeveslive under this Agreement for any breach of this Agreement and for any negligent or other act or omission based on this Agreement, will not exceed the amount of the gig/ad service Fee (Premuim package price) paid by you to Jeeveslive. Jeeveslive doesn’t control what other people say do or say, and we aren’t responsible for their (or your) actions or conduct (whether online or offline) or content (including unlawful or objectionable content). Jeeveslive also isn’t responsible for services and features offered by other people or companies, even if you access them through our Platform.
Dispute Resolution
In the event of any dispute between a Buyer and Seller, Jeeveslive recommends that the parties involved engage in pre-dispute arbitration using the chat module provided on the Jeeveslive Platform. Jeeveslive may help to facilitate the resolution of any dispute between a Buyer and Seller as well as reserves the right to cancel the sale of the services. If any Buyer and Seller cannot come to agreement on a dispute, Jeeveslive recommends that legal advice is sought to resolve such issue.
General Terms
If any stipulation of this Agreement is judged to be invalid or unenforceable for any reason by any court of relevant jurisdiction, such invalidity or unenforceability (unless the deletion of such stipulation would materially adversely affect any of the parties) will not affect the operation or interpretation of any other stipulations of this Agreement to the intent that the invalid or unenforceable stipulation will be considered as severed from this Agreement.
Jeeveslive may assign its rights and transfer obligations which arise under this Agreement. You mustn't assign or transfer your rights or obligations under this Agreement without the prior written consent of Jeeveslive (which may be withheld).
Jeeveslive reserves the right to modify these Terms of Use at any time. If you disagree with the revised terms, you may not use the Jeeveslive Platform. Your continued access to or use of the Jeeveslive Platform will constitute acceptance of the revised Terms of Use.
